Consumer — the person whose name, contact and billing details are given during ordering and shown in the order summary.
Article 2 – Subject
This agreement governs the rights and obligations of the parties in relation to the supply of digital content ordered electronically by the Consumer through the Career Ladders platform (https://careerladders.org), in accordance with Directive 2011/83/EU on consumer rights and Directive (EU) 2019/770 on contracts for the supply of digital content and digital services, as implemented in the Consumer’s country of residence.
Article 3 – Service and price
The name of the package, the modules it includes, its term, the total price inclusive of taxes and any discount are as shown in the order summary, which forms an integral part of this agreement. No delivery or comparable charge is added.
Article 4 – Pre-contractual information
Before confirming the order, the Consumer confirms having received and understood the Pre-Contractual Information, covering the identity of the Trader, the main characteristics of the service, the total price, the arrangements for payment and performance, the exception to the right of withdrawal, the legal guarantee of conformity and the available complaint procedures.
Article 5 – Payment
Payment is made by credit or debit card through the secure infrastructure of the Trader’s payment institution. Card details are not visible to, and are not stored by, the Trader. If payment fails or is reversed by the issuing bank, the Trader is released from the obligation to supply.
Article 6 – Supply
The digital content is supplied immediately after payment is confirmed, by applying the package entitlements to the Consumer’s account. The term begins at that moment and runs for the number of days stated in the order summary.
If supply becomes impossible through force majeure or for reasons attributable to the Consumer, the Trader informs the Consumer and refunds any amount collected within fourteen days.
Article 7 – Right of withdrawal
The subject of this agreement is digital content supplied without a tangible medium, with performance beginning immediately. In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal is lost once performance has begun, where the Consumer has given prior express consent to that and has acknowledged the loss of the right.
Both confirmations are collected on the purchase screen before the order is placed. Where they have not been given and supply has not started, the Consumer may withdraw within fourteen days by an unequivocal statement to [email protected], and all payments received are refunded within fourteen days using the original means of payment.
Article 8 – Conformity and remedies
The Trader is liable for any lack of conformity of the digital content existing at the time of supply and, as this content is supplied continuously over the term, for any lack of conformity occurring during that term. The Consumer may require the content to be brought into conformity and, where that is not possible or fails, may obtain a proportionate price reduction or terminate the contract, in accordance with Directive (EU) 2019/770.
Where an interruption attributable to the Trader lasts an unreasonable length of time, the term of the package is extended by the duration of the interruption.
Article 9 – Consumer obligations
The Consumer is responsible for the accuracy of the information given when ordering, for the confidentiality of account credentials, and for using the service in accordance with the Terms of Use. The entitlement is personal; it may not be transferred or shared with third parties.
Article 10 – Personal data
Personal data processed in connection with the order is handled as described in the Privacy Policy. Invoice and payment records are retained for the periods required by tax and commercial legislation.
Article 11 – Purchases through app stores
This agreement does not apply to purchases made through the App Store or Google Play, where the store is the seller and its own sales and refund terms govern.
Article 12 – Governing law and disputes
This agreement is governed by Turkish law. This choice does not deprive a Consumer resident in the European Union of the protection of the mandatory provisions of the law of their country of residence, and such a Consumer may bring proceedings before the courts of that country. Complaints may also be referred to a competent consumer alternative dispute resolution body under Directive 2013/11/EU.
Article 13 – Entry into force
The agreement is concluded and enters into force when the Consumer confirms the order electronically. A copy is kept in the Consumer’s account and sent by e-mail on request.
